Robert Hall was the expert witness in the only plaintiff's case Jonathan Hare worked at Cornerstone Research — the knee-implant licensing case in which Hall took the damages model Hare developed and cranked every parameter to the maximum: every vendor licensing at a 5% royalty for the patent's full twenty years. Hare thought the assumption ridiculous; Hall assured him the testimony would persuade the jury; the compensatory verdict was $90 million, exactly on the model. The lesson Hare took — juries punish violations of good faith and fair dealing, and an expert gives them the excuse — became a lifelong negotiating instrument. The story, as told to Ceridian.
